Is mediation voluntary? Yes. As of January 2014, no legislation has yet been published in the Government Gazette making pre-litigation mediation compulsory. Court-assisted consensual mediation has now been provided for in recent amendments to the Magistrates Court Rules. As such, mediation, both pre-litigation and during litigation, is commenced only by agreement.
